Controversial contractor Sarah Discaya and nine co-accused are preparing to call 26 witnesses to defend against graft and malversation charges related to an alleged P96.5-million ghost flood control project in Davao Occidental. The Office of the Ombudsman has accused public officials of receiving full payment in February 2023 for a Department of Public Works and Highways (DPWH) project that was never completed.

Defense Claims Project Completed but Damaged by Natural Disasters

Lawyers for the accused argue that the flood control project was actually finished but later destroyed by typhoons and heavy rains. Joseph Randi Torregosa, representing DPWH district officer-in-charge Rodrigo Larete, stated that unfinished repairs were delayed due to local political conditions. Paul Tristan Sato, lawyer for the other DPWH officials, supported this claim, emphasizing that the project's deterioration was beyond their control.

Witness Line-Ups Finalized in Pre-Trial Hearing

During an online pre-trial hearing on Tuesday, March 10, 2026, both sides finalized their witness lists. The defense plans to present 26 witnesses, including nine for Larete, 13 for other DPWH officials, three for contractor Maria Roma Rimando, and one for Discaya. In contrast, the prosecution listed 18 witnesses, comprising personnel from the Bureau of Internal Revenue and the Securities and Exchange Commission. Of these, 11 will identify documents, while seven will provide testimonial evidence.

Court Sets Procedures and Trial Schedule

Lapu-Lapu City Regional Trial Court Branch 27 Judge Nelson Leyco has given the prosecution five days to submit a witness summary. This summary will help Judge Leyco determine whether witnesses must appear in person, as requested by the defense to observe their demeanor, or if they can testify online. The trial is scheduled to commence on April 7, with 12 hearing dates planned through September, ensuring a thorough examination of the evidence and arguments from both sides.
