Davao Light Officially Takes Over Power Distribution in Samal Following Court Order
Davao Light and Power Company has formally commenced operations of the power distribution system in the Island Garden City of Samal, following the implementation of a Writ of Possession issued by the Regional Trial Court Branch 4 in Panabo City. This significant development marks a crucial milestone in the company's expansion efforts across Davao del Norte and Davao de Oro regions.
Supreme Court Ruling Clarification
During a press conference held on February 26, 2026, Enriczar Tia, President of Davao Light, addressed widespread interpretations of the recent Supreme Court decision. Tia emphasized that the ruling does not indicate any "parallel operation" between Davao Light and Northern Davao Electric Cooperative (Nordeco), asserting that the company's expanded franchise remains both valid and fully enforceable.
"There is nothing in the Supreme Court resolution that says parallel ang [ilahang] operation," Tia stated clearly. "Simple lang ang ruling ni Supreme Court. Actually, the resolution that came out of the petition for certiorari and the TRO filed by Nordeco was dismissed. Meaning, valid ang balaod and executory ang RA 12144 — all the provisions granting Davao Light's expanded franchise in the expanded areas of Davao del Norte and Davao de Oro."
Tia further explained that the High Court's decision confirms the constitutionality of Republic Act No. 12144, making it immediately enforceable and allowing Davao Light to proceed with its expansion plans, including operations in the Island Garden City of Samal.
Legal Authority and Implementation
"Kung basahon ninyo ang resolution, there is no statement there that both utilities should operate at the same time in the same area. Wala gyud," Tia added. "The franchise is not exclusive. Congress has the power to amend, alter, or repeal franchises."
On the same day as the press conference, the Island Garden City of Samal formally welcomed Davao Light as it assumed control of the city's entire power distribution system. This transition encompasses all distribution assets throughout the city, including electric poles, lines, transformers, and related infrastructure, in strict compliance with Republic Act No. 12144.
Transition Process and Customer Services
Tia revealed that preparations for this transition had been actively underway since the previous year, with the company now moving forward with full implementation following the Supreme Court's dismissal of Nordeco's petition. With the turnover now in effect, residents and business owners—including beach resort operators who represent significant economic contributors to the city—can directly coordinate with Davao Light for all service-related concerns.
City officials have been conducting extensive barangay visits to inform communities about the transition process and the availability of services. Currently, a dedicated customer service center has been established at Igacos Commercial Center, Inc., located at P-6 Sitio Kaimito, Barangay Miranda, Babak District, Island Garden City of Samal.
The company has also launched a dedicated 24/7 hotline (0919 057 3572) to address inquiries and service-related issues promptly, ensuring continuous support for the community during this transition period.
Continued Dialogue and Service Commitment
Despite the operational transition, Tia maintained that Davao Light remains open to constructive dialogue with Nordeco, particularly regarding ensuring an orderly transition in other areas covered by the expansion. He reiterated the company's commitment to strictly adhering to court directives while prioritizing stability, continuity, and dependable electric service for all communities now under their service coverage.
Clarifying "Parallel Operation"
The concept of "parallel operation" refers to two utilities operating simultaneously within the same geographical area. Davao Light has clarified that this arrangement was not provided under Republic Act 12144, though the company will fully abide by both the provisions of the law and the Supreme Court ruling.
This development does not automatically require Nordeco to immediately cease operations in its current service areas, nor does it compel consumers to switch to Davao Light. The company emphasized that while the law permits expansion and assumption of operations in newly covered areas, customers retain the freedom to choose their preferred service provider.
Davao Light has reiterated that the Supreme Court ruling affirms the validity of its expanded franchise and clearly supports the company, providing legal authority to implement operations throughout Davao del Norte, Davao de Oro, and the Island Garden City of Samal.
