House Committee Initiates Motu Proprio Probe into Solar Para sa Bayan Franchise

The House Committee on Legislative Franchises has announced it will conduct a motu proprio investigation into the franchise of Solar Para sa Bayan Corporation. This move comes in response to mounting concerns over the company's compliance with legal requirements and its commitment to consumer protection standards.

PhilRECA Party-list Representative Presley De Jesus formally introduced the motion for this investigation. His action was prompted by reports alleging several irregularities involving Solar Para sa Bayan. These include the purported sale or transfer of controlling interest in the company without congressional approval, failures to adhere to specific franchise conditions, and claims that the corporation has been non-operational since 2022 due to regulatory delays.

Representative De Jesus emphasized that a legislative franchise is a privilege, not a right, granted by Congress. Therefore, it is the duty of lawmakers to ensure such franchises are used in strict accordance with the law and for the public good. Following the approval of the motion, APEC Party-list Representative Sergio C. Dagooc called upon the Energy Regulatory Commission (ERC) to examine previous issues linked to Solar Para sa Bayan in areas where it has operated.

ERC Urged to Scrutinize Past Operations

The issues highlighted for ERC review encompass alleged operations without proper permits, the absence of approved tariffs, and the unauthorized use of facilities belonging to the Occidental Mindoro Electric Cooperative. The Power Bloc, a coalition within the House, has long opposed the granting of a broad nationwide franchise to a single private entity like Solar Para sa Bayan.

They argue that such an arrangement is difficult to monitor effectively and contradicts the local nature of electric distribution services. The group clarified that the investigation is not intended to prejudge the outcome but aims to uncover all relevant facts before Congress makes any final decisions regarding the franchise.

Power Bloc Stresses Franchise Criteria

In their statement, the Power Bloc reiterated that the awarding of any legislative franchise should be based on clear criteria. These include the applicant's proven capability, a solid record of legal compliance, and a genuine ability to serve the public interest. This is particularly crucial in advancing affordable and reliable electricity access in rural and underserved communities across the Philippines.

The investigation underscores ongoing legislative efforts to uphold accountability within the energy sector and protect consumer rights amidst evolving market dynamics.
