Who is Eligible for the 13th Month Pay?
The DOLE has explicitly stated that no company is exempt from this mandate. The benefit must be granted to all rank-and-file workers. This applies regardless of an employee's specific job title, designation, or their employment status. Even the method of wage payment does not affect eligibility. The key requirement is that the employee must have worked for at least one month during the calendar year.
The calculation for the minimum 13th month pay is clear: it should not be less than one-twelfth (1/12) of the total basic salary the employee earned within the year.
Deadlines and Compliance Reporting
Employers are reminded that the 13th month pay must be given to workers on or before December 24. Furthermore, in a significant move for transparency, the DOLE has mandated all employers to submit a formal report confirming their compliance.
This report must be filed using the official DOLE Online Compliance Portal at https://reports.dole.gov.ph/. The submission deadline is set for January 15, 2026. Failure to comply can result in penalties as the appropriate DOLE Regional, Field, or Provincial Offices will be actively monitoring workplaces under their jurisdiction.
