Defense Files Motion to Quash
Most of the accused, several of whom are officials from the Department of Public Works and Highways (DPWH) in Davao Occidental, filed a motion to quash information. Their legal argument centers on the applicability of OCA-Circular No. 328-2025. The defense contends this Supreme Court directive should not be imposed on the accused officials.
Lawyer Argues for Case to Remain in Davao Occidental
Attorney Joseph Randi Torregosa, representing Rodrigo Larete (officer-in-charge of the DPWH Davao Occidental District Engineering Office), elaborated on the defense's position. He stated that the Supreme Court's order to transfer cases to another judicial region is not applicable in this instance.
Torregosa emphasized that the case should remain under the jurisdiction of RTC Malita in Davao Occidental. The basis for this argument is that none of the accused hold a position with a Salary Grade of 27 or higher, which is a key criterion outlined in the Supreme Court's mandate.
Awaiting the Judge's Decision
Presiding Judge Nelson Leyco of RTC Branch 27 has not yet issued a ruling on the motions presented by the defense. The court will reconvene at a later date to address these procedural matters before proceeding with the substantive aspects of the case.
