The House prosecution panel expressed confidence that the impeachment trial of Vice President Sara Duterte will immediately proceed after the Senate formally convenes as an impeachment court. Lead prosecutor and Batangas Rep. Gerville “Jinky Bitrics” Luistro stated that there is no legal hindrance to the continuation of the trial since the Supreme Court has not issued a temporary restraining order.
Luistro emphasized that the constitutional directive of “forthwith” applies not only to the convening of the impeachment court but also to the immediate start of the trial, including the presentation of evidence and witnesses. He clarified that the trial will proceed even if Duterte fails to attend or submit a response to the complaint, as under Senate rules, this will automatically be considered a plea of not guilty.
Meanwhile, Akbayan Rep. Chel Diokno said the prosecution panel is ready for the trial and sees no obstacles in the process. Earlier, the Senate ordered Duterte to submit her response to the articles of impeachment within 10 days from receipt of the summons. After this, the pre-trial and trial proper will be scheduled.
