The Office of the Ombudsman has firmly stated that the Filipino cultural concept of 'utang na loob' (debt of gratitude) has no place in public offices or among government officials. In a statement, the Ombudsman stressed that a public servant's responsibility to the people far outweighs any perceived debt of gratitude to any donor.
Ombudsman acknowledges cultural practice but draws line
While issuing this reminder, the Ombudsman acknowledged the Filipino tradition of utang na loob, particularly when it occurs among family members, friends, and acquaintances as a gesture of gratitude. However, the office made it clear that such a practice cannot be used to justify actions that violate the law, especially in the context of public service.
The statement came after the Ombudsman filed charges against Senator Rodante Marcoleta, former Anakalusugan Party-list Representative Mike Defensor, and several others. They are facing charges of plunder and violation of Presidential Decree No. 46, which prohibits government officials from accepting gifts.
Cases stem from admitted campaign donations
The cases originated from Senator Marcoleta's own admission of receiving alleged campaign donations. According to the Ombudsman, Marcoleta argued that he had utang na loob to the donors, which led to the discovery of donations worth PHP 75 million. The Ombudsman stated that this reasoning precisely illustrates why laws against plunder and bribery were enacted.
Despite several days of rallies by Marcoleta's supporters, including members of the Iglesia Ni Cristo, the Ombudsman proceeded with the filing of charges. In a message delivered during one of the rallies, Marcoleta said he is ready to be arrested in connection with the plunder case. He expressed no problem if his arrest serves as payment for defending justice and the interests of the Filipino people.
Next steps await Sandiganbayan action
Now that the senator has been formally charged, the next steps depend on the Sandiganbayan. One possibility is that the court may issue a warrant of arrest against Marcoleta to take him into custody.
