CCTV footage from the scene captured the moment when speeding motorcycles collided with the victim, Ivan Serintas Avila, a 35-year-old delivery rider. The impact caused severe and fatal injuries to his head and body, leading to his immediate death at the spot. Police Lieutenant Colonel Franco Rodulf Oriol, the information officer of the Cebu City Police Office, identified the primary driver involved as Dendril Montehermoso, a resident of Sitio Upper Kawayan in Barangay Sambag 2.

After receiving medical treatment at a hospital, Montehermoso was discharged and promptly taken to the Mabolo Police Station. There, he faces serious charges of reckless imprudence resulting in homicide and damage to property. Oriol emphasized that no information has been received regarding any settlement between the involved parties, and the police are awaiting the victim's family to formally file a case to proceed with legal actions.

In a statement, Oriol clarified the police's stance, stating, "Even if there are agreements between the parties, as far as the police is concerned, we will file the case of reckless imprudence resulting in homicide." Additionally, Oriol revealed that Montehermoso underwent a liquor test following the incident, which returned a negative result, indicating that alcohol was not a factor in the collision.

Second Driver Surrenders and Legal Proceedings

Meanwhile, another motorcycle driver involved in the incident, a 16-year-old minor, has voluntarily surrendered to authorities. This teenager is currently undergoing discernment proceedings under the supervision of the Department of Social Welfare and Development.
