The controversy stems from a complaint lodged by Director Lucero against officials of the SimplyShare Foundation Inc. (SSFI), alleging illegal solicitation activities. However, the Cebu City Prosecutor's Office dismissed this case on July 24, 2025, citing insufficient evidence against Governor Baricuatro and her daughter, Elisse Nicole B. Catalan.

The allegations centered on purported violations of Presidential Decree 1564, the Solicitation Permit Law, linked to the Cybercrime Prevention Act, due to donation appeals made on the foundation's website and social media platforms. Prosecutors clarified that the "screenshots" from social media presented as evidence failed to meet the standards of truthfulness under the Rules on Electronic Evidence.

Baricuatro's camp acknowledged the existence of online posts soliciting donations but argued these were made in "good faith" to support feeding programs and disaster relief efforts. The prosecution concurred, noting no criminal intent was evident as funds were genuinely directed to those in need.

Criticism of DSWD Procedures and Foundation's Recognition

The resolution also criticized the DSWD for bypassing proper procedural steps. According to DSWD regulations, three "notices" must be issued before filing a case, a requirement the agency neglected to fulfill. Additionally, the DSWD had previously recognized and honored the foundation, including granting it a license to operate until 2028, which further complicated the allegations.

During her visit, Governor Baricuatro highlighted the impactful work of the Cebu Food Bank, which originated as a home-based feeding initiative in 2015 and expanded into a major operation by 2023. The foundation focuses on addressing hunger in underserved areas, particularly among children, by collecting surplus food and donations from corporate partners. "The Cebu Food Bank gathers excess food and contributions from partner companies," Baricuatro explained, reaffirming the organization's vital role in community support.
