Davao Councilor Demands Inquiry into Skin Clinic Operations Following Tragic Overdose
In a move to bolster public health protections, Davao City Councilor Ralph Abella has formally requested a legislative inquiry into the operations of skin disease treatment clinics and dermatology facilities across the city. This initiative comes in response to a distressing incident involving a senior citizen, which has raised alarms about patient safety and regulatory oversight.
Fatal Incident Sparks Urgent Concerns
The push for investigation was triggered after Councilor Abella's office received reports of a senior citizen who died following a medication overdose. According to Abella, the patient was prescribed medication for a skin condition but tragically misunderstood the dosage instructions. Instead of taking six capsules over the course of one week, the patient reportedly consumed six capsules daily, leading to a fatal overdose.
In a privilege speech delivered on Tuesday, March 10, 2026, at the Sangguniang Panlungsod, Abella emphasized that his intent is not to accuse any specific clinic, physician, or establishment. However, he stressed that this unfortunate event highlights serious questions that warrant thorough review and attention from local authorities.
Objective: Ensure Safety and Compliance
The primary goal of the inquiry, as outlined by Abella, is to assess which establishments are adhering to existing laws and to identify if additional safeguards and regulatory measures are necessary to protect the public. He clarified that the inquiry is not targeted at any particular entity but aims to ensure that all medical and dermatological services in Davao City are safe, lawful, and supervised by qualified professionals.
To achieve this, the inquiry will involve key stakeholders, including representatives from the Department of Health (DOH), Professional Regulation Commission (PRC), Philippine Medical Association, Philippine Dermatological Society, the City Health Office, the Business Bureau, and concerned clinics or establishments. This collaborative approach is designed to provide proper guidance and clarity on regulatory standards.
Legal Framework and Public Health Duty
Abella highlighted the importance of compliance with national laws, such as Republic Act No. 2382, also known as the Medical Act of 1959, along with DOH regulations and PRC requirements. He underscored the duty of the city government under the Local Government Code of 1991 to regulate businesses and activities that impact public health and safety, emphasizing the need to uphold the well-being of constituents in medical treatment matters.
Furthermore, Abella noted that skin diseases like eczema and psoriasis are prevalent among Dabawenyos and require accurate diagnosis and treatment by licensed physicians. He warned that improper medication or incorrect dosages can lead to severe complications and health risks, reinforcing the urgency of this inquiry.
Resolution Filed for Legislative Action
In response to these concerns, Councilor Abella has filed a resolution directing the appropriate committee of the Sangguniang Panlungsod to conduct the inquiry in aid of legislation. This step aims to scrutinize the operations of skin disease clinics and dermatology facilities, with the ultimate goal of implementing measures that enhance patient safety and regulatory enforcement in Davao City.
