DHSUD Halts Moalboal Developer Over Permit Violations, Warns Public
Moalboal Developer Ordered to Stop Sales by DHSUD

The Department of Human Settlements and Urban Development (DHSUD) has taken decisive action against a real estate developer in Moalboal, Cebu, issuing a formal cease and desist order that mandates an immediate halt to all operations. This move comes as a critical warning to residents and potential homebuyers in the area, emphasizing the importance of verifying legal permits before engaging in any property transactions.

Government Order Targets WJV Bayfront Subdivision

In a significant enforcement step, DHSUD has directed WJV-HP Real Estate Inc. to stop all sales activities and cease collecting monthly amortization payments from current buyers. The order specifically focuses on the WJV Bayfront Subdivision located in Barangay Saavedra, Moalboal. To ensure widespread public awareness, the Municipality of Moalboal shared this warning on its official Facebook page on Monday, February 9, 2026, highlighting the legal issues surrounding the project.

Serious Legal Violations Uncovered

An investigation by town officials and DHSUD revealed multiple severe violations by the real estate firm. The project was found to be operating without essential legal requirements, including:

  • A License to Sell: This is a mandatory prerequisite for any developer to offer lots to the public, ensuring compliance with regulatory standards.
  • Certificate of Registration: The subdivision project was never officially registered with the proper authorities, raising concerns about its legitimacy.
  • Approved Advertisements: The company promoted the project without obtaining necessary government clearance, misleading potential buyers.

These actions constitute a breach of Presidential Decree No. 957, a law enacted in 1976 specifically designed to protect homebuyers from unfair or dishonest business practices in the real estate sector.

Investigation and Public Advisory

The cease and desist order, dated November 21, 2025, was signed by DHSUD 7 Director Eva Maria Marfil. This decision followed a comprehensive physical inspection of the site and a thorough review of official records by government officials. In a public advisory written in Cebuano, authorities warned: “Attention to everyone interested in buying a house and lot in Moalboal, the WJV Subdivision has been issued a Notice of Violation and a Cease and Desist Order.” This advisory aims to prevent further public harm by alerting potential buyers to the legal risks involved.

Current Status and Buyer Precautions

As of now, WJV-HP Real Estate Inc. has not released a public statement regarding the order, and attempts to contact the company via phone calls and emails have remained unanswered. This government action serves as a stark reminder for all buyers to diligently verify that a developer possesses a valid License to Sell before committing any funds. For the time being, the WJV Bayfront Subdivision project remains legally frozen until these violations are adequately addressed, underscoring the need for vigilance in the real estate market to avoid financial and legal pitfalls.
