Senate Gears Up for Impeachment Court Role Against Vice President Duterte
Senate President Vicente Tito Sotto III has publicly affirmed that the Senate is actively preparing to potentially convene as an impeachment court, should the House of Representatives formally transmit complaints seeking the removal of Vice President Sara Duterte. Sotto, who is expected to preside over any such trial, emphasized the chamber's commitment to readiness and procedural integrity.
Informal Discussions and Preparatory Measures
In a recent development, Sotto disclosed that he hosted a dinner with several lawmakers from the Senate's majority bloc to discuss the possible reception of Articles of Impeachment. He clarified that this gathering was not an official meeting or caucus of the Senate, but rather an informal consultation to address logistical and procedural considerations. Sotto stressed that the Senate will remain impartial during any trial, awaiting the formal presentation of evidence and arguments.
To ensure thorough preparation, Sotto revealed he is undergoing a crash program on the Rules of Court, aiming to adapt these rules to the Senate's own protocols. Since February, he has been receiving briefings from lawyers affiliated with the Court of Appeals and the Court of Tax Appeals, bolstering his understanding of legal frameworks relevant to impeachment proceedings.
Constitutional Mandate and Timely Action
This preparation aligns with Article XI, Section 3(4) of the 1987 Constitution, under which Sotto pledged to act forthwith or immediately upon receiving a formal complaint from the House. The constitutional provision mandates swift Senate action in impeachment cases, underscoring the urgency of these preparatory steps.
Recall that last month, the House Committee on Justice initiated hearings on impeachment complaints against Vice President Duterte after the committee found them sufficient in form, substance, and grounds. This move has set the stage for potential escalation to the Senate, pending further House deliberations.
Vice President's Defense and Ongoing Political Dynamics
On the other side, Vice President Sara Duterte continues to maintain her stance that the complaints against her should be dismissed due to a lack of evidence. Her defense highlights the contentious nature of the allegations and the political tensions surrounding the impeachment process.
The Senate's preparations reflect a proactive approach to upholding constitutional duties, ensuring that if called upon, the chamber can conduct a fair and efficient trial. As developments unfold, all eyes remain on the House's next steps and the Senate's readiness to fulfill its judicial role in this high-stakes political scenario.
