Hospitalization and Allegations
Garcia stated he was rushed to Talisay District Hospital at around 4:30 p.m. on June 12, crediting the Talisay Rescue Emergency Assistance Team for his transfer. He was later moved to Vicente Sotto Memorial Medical Center. In a Facebook post, Garcia said, “Reason for this emergency? Police maltreatment.” He added that he is still recovering and awaiting final medical assessment.

Presiding Judge Jennifer Pepito-Maniwang of Mandaue City Municipal Trial Court in Cities (MTCC) Branch 1 issued the release order on June 13. Garcia’s arrest occurred on June 11 at 4:35 p.m. at the Talisay Fish Port, executed by personnel from the Cebu Police Provincial Office and Talisay City Police Station based on a court warrant.
Safe Spaces Act Case
Garcia, brother of former governor Gwendolyn Garcia, faces trial on July 29 at Mandaue City MTCC Branch 1 for three counts of gender-based online sexual harassment under Republic Act 11313, or the Safe Spaces Act. The charges stem from a complaint by Cebu Province public health consultant Dr. Elisse Nicole Catalan, who accused Garcia of misogynistic remarks, body-shaming, and sexist ridicule in public Facebook posts and videos.
Evidence of Online Harassment
The Mandaue City Prosecutor’s Office found probable cause based on electronic evidence, including screenshots and videos authenticated by the National Bureau of Investigation. Specific posts cited include an April 7, 2025 post where Garcia called Catalan “Miss Chubby Catalan,” and a July 27, 2025 video describing her as “overweight, obese and not healthy.” A court order dated June 9 confirmed jurisdiction and allowed trial under RA 11313, noting the charges were cyber-facilitated but not seeking heavier penalties under the Cybercrime Prevention Act.
