Comelec Throws Out Gubernatorial Disqualification Case
The Commission on Elections (Comelec) First Division has officially dismissed the disqualification case filed against Cebu Governor Pamela "Pam" Baricuatro. The decision, rendered on November 19, 2025, came after the petitioner failed to meet mandatory filing requirements under Comelec Resolution 11046.
Technical Grounds Lead to Case Dismissal
In their ruling, the First Division revealed that petitioner Katrina Kaye Kowalik, former head of the Capitol's social media arm Sugbo News, failed to submit crucial documentation. Specifically, Kowalik did not provide proof of delivering the petition and its complete annexes to the respondent, along with the required affidavit of service.
The Comelec emphasized these requirements cannot be disregarded as they are mandatory under election rules. A portion of the First Division's decision stated clearly: "Failure to comply with a mandatory requirement warrants the dismissal of the petition," before ultimately junking the case.
Background of the Controversial Petition
The original complaint accused Governor Baricuatro of violating Section 5 in relation to Section 3 of Republic Act 9006, also known as the Fair Election Act. Additional allegations cited violations of Comelec Resolutions 11086 and 11117.
The case originated from a social media post that indicated Baricuatro was leading the gubernatorial race with 82 percent of votes. Cebu Province Assistant Administrator Aldwin Empaces confirmed to media on Wednesday, November 19, 2025, that they had received the Comelec order dated November 4.
When questioned about the disqualification reasons, Empaces stated: "They had many bases. Basically, the petition submitted by the complainant was not substantive."

The dismissal of the case allows Governor Baricuatro to focus entirely on governance and ongoing recovery efforts. Empaces added that the resolution enables the governor to concentrate on administrative duties without the distraction of legal challenges.
