According to the court's decision, the prosecution did not prove the material allegations related to the alleged entrapment transaction because the witnesses lacked sufficient personal knowledge of the actual events. Additionally, several statements were considered hearsay and lacked evidentiary weight. The court also found that it was not proven that Orallo pretended to be an engineer in a manner that induced the complainant to pay money.
Insufficient Proof of Fraud or Damage
The evidence was insufficient to prove the damage or prejudice caused by the accusation, even at the level of attempted fraud. Overall, the court declared that the evidence was not enough to support the indictment, thus dismissing the case against Orallo.
Background of the Arrest
Orallo was arrested by the Pasig City Police in an entrapment operation in Barangay Sto. Tomas, Pasig City. He was caught holding marked money after allegedly pretending to be an engineer and charging the complainant PHP 328,000 in exchange for a building permit. However, based on confiscated documents, the signatures used were fake.
Mayor's Statement and ARTA's Response
Pasig City Mayor Vico Sotto ordered an investigation into whether Orallo had accomplices inside the city hall. He also warned the public not to transact with fixers and to immediately report suspicious activities. The Anti-Red Tape Authority (ARTA) praised the local government of Pasig for its swift action against fixers.
