A controversial incident involving the apprehension of a bottled water vendor at Plaza Sugbo in Cebu City has escalated into a formal human rights concern, prompting action from a city councilor and the local government.
Councilor Alcover Initiates Human Rights Complaint
Cebu City Councilor Pastor “Jun” Alcover Jr. announced plans to file a formal complaint with the Commission on Human Rights (CHR) regarding the treatment of the vendor. The councilor stated that the incident, which was captured on video and spread online, constituted a violation of the individual's rights.
According to Alcover, the vendor claimed to have experienced coercion or abuse without proper warning or explanation that vending was prohibited in the area. The manner of the arrest raised serious concerns about due process and respect for human rights, particularly for small-scale vendors simply trying to make a living.
Alcover intends to tackle the issue through a privilege speech during the Cebu City Council's regular session on January 6. He also plans to invite affected vendors and CHR representatives to provide their perspectives and recommendations on handling similar cases in the future.
City Government's Response and Internal Investigation
In response, Cebu City Mayor Nestor Archival Sr. expressed full support for Alcover's decision to involve the CHR. He described it as an opportunity to clarify the incident and ensure accountability.
"I am very happy that he is doing that. Thank you very much for what you have done," Mayor Archival stated. He revealed that the city government had already issued a memorandum directing the head of the Prevention, Restoration, Order, Beautification and Enhancement (Probe) unit to face city officials and submit a written report within 24 hours.
The mayor confirmed that a formal investigation has begun, and appropriate action will be taken against any personnel found to have committed wrongdoing. "This is part of our effort to ensure that our ordinances are enforced properly and humanely," Archival emphasized.
Vendor's Account and Public Backlash
One of the vendors involved, 37-year-old Ruel Omaba, shared his experience with Probe personnel during the controversial arrest at Plaza Sugbo. Omaba claimed he was not actively selling bottled water in front of Cebu City Hall at the time. He said he was merely passing through the area and did not expect to be stopped.
He recounted that his bottled water was suddenly taken, and he was dragged towards the outside of City Hall without being told what he did wrong, leaving him confused and frightened. The incident gained significant public attention after the confiscation video went viral on social media, sparking varied reactions from netizens.
Mayor Archival reiterated that vending at Plaza Sugbo is prohibited under City Ordinance No. 2686. However, he stressed that law enforcement must always be based on compassion, clear communication, and respect for human dignity.
