The warrant of arrest issued against former newscaster Jay Sonza states that his case is non-bailable, meaning he cannot post bail. However, his legal counsel, Atty. Mark Tolentino, contested this classification, arguing that non-bailable offenses are those punishable by reclusion perpetua or life imprisonment.
Tolentino pointed out that cyberlibel carries a maximum penalty of only six months imprisonment, making him wonder why his client cannot post bail. He also questioned why the National Bureau of Investigation (NBI) filed the case, as they are not the offended party. Furthermore, Tolentino expressed confusion over why the case was filed in Pasay City when President Bongbong Marcos resides in Malacañang, Manila.
The 70-year-old Sonza was arrested by the NBI for allegedly spreading fake news about President Marcos's health.
