Former Department of Public Works and Highways (DPWH) engineer Henry Alcantara is formally challenging the revocation of his professional license, arguing that the regulatory body acted too hastily on a case still under investigation.

Motion for Reconsideration Filed

Through his legal counsel, Alcantara has filed a Motion for Reconsideration (MR) before the Professional Regulatory Board of Civil Engineering (PRB-CE). He is urging the board to reverse its own decision dated January 7, 2026, which stripped him of his license to practice as a civil engineer.

In his appeal, Alcantara contends that the board's ruling was based on evidence from matters that are "pending for investigation and has yet to be resolved." His lawyers argue that revoking his license under these circumstances is fundamentally unfair and premature.

Alleged Violation of Due Process

The core of Alcantara's defense hinges on the right to due process. "To act with haste is a violation of respondent Alcantara's right to due process," the motion stated. He emphasized that while the PRB-CE is empowered to render judgment, it must still observe proper legal procedures.

The motion further claims the board committed a "gross misapprehension of facts" in finding him guilty. It respectfully prays for the office to "reverse, set aside, and nullify" the revocation order.

The PRC's Stance on the Case

The PRB-CE's original decision to revoke Alcantara's license came after it found him guilty of gross unprofessional and unethical conduct. The case is connected to flood control projects.

In a statement, the Professional Regulation Commission (PRC) said, "The Board established that Engineer Alcantara willfully approved payments for these ghost projects, an act that constitutes a severe breach of the Code of Ethics for Civil Engineers and a betrayal of public trust."

Next Steps in the Legal Process

Under existing rules, Alcantara had the right to file an MR with the PRB-CE within 15 days from receipt of the decision. Should his motion for reconsideration be denied, he retains the right to file a notice of appeal with the full commission within another 15-day period.

The outcome of this appeal will determine whether the former DPWH engineer can regain his professional standing or if the revocation will stand permanently.
