Ombudsman Moves to Charge Curlee Discaya in Multi-Million Peso Flood Control Scandal
The Office of the Ombudsman has disclosed that the Department of Public Works and Highways (DPWH) is pushing for criminal charges against Pacifico 'Curlee' Discaya, the husband of Sarah Discaya, in connection with a fraudulent flood control project. This development follows the department's formal manifestation submitted through Secretary Vince Dizon, as confirmed by Assistant Ombudsman and Spokesperson Atty. Mico F. Clavano.
Details of the Alleged Anomaly
According to Clavano, the case centers on a ghost flood control project in Davao Occidental valued at 96.5 million pesos. The Ombudsman aims to include Discaya in specific charges of malversation and graft, alleging his involvement in the scheme. The evidence stems from affidavits provided by various individuals who have implicated Discaya as having beneficial ownership over companies linked to the anomaly.
Clavano explained that as a beneficial owner, Discaya may have signed documents on behalf of these corporations, even if his name does not appear in official company records. Alternatively, he could have issued directives to employees involved in the fraudulent activities. Such actions, Clavano noted, could legally classify individuals like Discaya as beneficial owners, making them accountable under the law.
Challenges and Cooperation in the Investigation
The Ombudsman acknowledged that cases involving beneficial ownership present significant challenges, as the names of those implicated are often not listed in corporate documents. However, Clavano expressed gratitude for the cooperation of whistleblowers and other individuals who have assisted the Office of the Ombudsman in identifying the true beneficial owners of the companies involved.
